Booking Terms and Conditions

This information should be read carefully before booking any course, activity, or freelance instructor with EarthCraftuk Community Interest Company or EarthCraftuk Partnership for practical site work. We reserve the right to update these Terms and Conditions at any time, without notice.

Definitions

ECUKCIC means EarthCraftuk Community Interest Company (all training and courses)

ECUKP means EarthCraftuk Partnership (all practical site work)

The Learner means the person named on the Booking Form for courses run by ECUKCIC·      Booking form means the application form submitted to ECUKCIC

In writing means correspondence by post or email for both ECUKCIC or ECUKP

EarthCraftuk Community Interest Company (ECUKCIC)

1. AGREEMENT

Any agreement based on the outline terms and conditions arises upon the fulfilment of the following:

1.1
Receipt & clearance in ECUKCIC`s bank account of full payment or deposit in section 2 below and a fully completed booking form, a fully completed health form and acceptance by ECUKCIC in writing.

1.2
That the signature/electronic signature on the booking form is taken as the client attending the course or by a legally recognised agent of the client for and on their behalf. This agreement is governed by English Law.

1.3
The agreement is between ECUKCIC and the client(s) on the booking form and is the sole agreement between those parties.

1.4
ECUKCIC reserves the right to refuse bookings to any party or individual without the need to give reasons solely at ECUKCIC`s discretion and we will return any payment accompanying the booking form.

2. Prices

Whilst every effort is made to limit price rises to those given on the booking form ECUKCIC reserves the right to:

2.1
Alter prices should its costs in hosting a course increase for reasons beyond its reasonable control (including, without limitation, the cost of labour, transport and materials).

2.2
In the event that a price is altered the client(s) will be notified as soon as reasonably possible and the ECUKCIC balance of the altered price will be payable on the same terms as was the original price. In the event of the price being thus increased by 15% or more, the client may opt to cancel the booking and will then be entitled to a refund of all monies paid.

3. CANCELLATION

ECUKCICGiven the substantial preparation by ECUKCIC prior to any course or booking, the client/Leaner must be aware of the following conditions and therefore agrees to such:

3.1
Whilst every reasonable effort will be made to run a course as planned, there may be occasions, such as extreme weather or staff illness, that force the need to postpone any programme.  In this unlikely event the Learner will be transferred to another course or programme of equal value. Refunds will not be given.

3.2
ECUKCIC reserves the right to cancel any booking without reason or notice when full refund would be given. Please note – Cancellation means the programme is cancelled (with no equivalent programme running in it`s place) and would not be intended to run at all in the future – in those circumstances a full refund will be given.

3.3
For bookings for ECUKCIC training programmes and courses - cancellation more than 56 days prior to the commencement of the course, payment will be retained but it can be transferred to another course, of equal value subject to availability.

3.4
For bookings for ECUKCIC training and courses - cancellation within 28 days prior to the commencement of any programme/course by the Learner, full course fee will be retained and no refund given.

3.5
For Learners attending accredited qualifications: The learner is required to attend all study days as stated for their designated programme, in the written confirmation and/or course material from ECUKCIC. If a learner is unable to attend any day due to unforseen circumstances, every effort will be made to accommodate on future training programmes subject to availability with certain exceptions as below:

For Learners attending Forest School Leader training - it is vital to keep to agreed training dates as planned on your programme.  For any cancellations within 28 days of the following components of your schedule, charges will be made as follows in order to re-book on future programmes to continue your training. You are however, welcome to send a colleague in your place to attend the Outdoor First Aid/Outdoor Food Safety training if you are unable to attend for any reason. However to rebook for yourself to continue your training, the following charges will apply:

  • Outdoor First Aid - £170 (mandatory requirement to achieve the Forest School Leader qualification)

  • Outdoor Food Safety - £120 (optional course – desired but not mandatory)

  • Delivery Assessment - £200

3.6
In the unlikely event that ECUKCIC cancels a course due to low numbers, all monies will be refunded in full, or if preferred, transferred as a deposit for another course. Please note that ECUKCIC requires a minimum number of 5 clients to run a course.

4. VARIATION OF COURSES BY ECUKCIC

An ECUKCIC course is, by its very nature, subject to natural forces and whilst every reasonable effort is made to comply with course content, ECUKCIC:

4.1
Reserves the right to vary or modify a course itinerary at short notice in order to take advantage of naturally prevailing conditions.

4.2
The client acknowledges that information provided by ECUKCIC is given to the best of our ability but because of the variability of nature it may be reasonable to alter or modify a course and that in such circumstances it is not reasonable for ECUKCIC to be liable for any losses consequential on such a change and that ECUKCIC`s liability is limited accordingly. 

5. LEARNER CONDUCT

5.1
ECUKCIC Learners are expected to behave in a reasonable manner at all times  and to comply with the reasonable instructions and directions given by ECUKCIC staff, visiting course leaders and volunteers,

5.2
Accompanying parents, teachers and those in comparable roles in respect of children, must maintain appropriate behaviour protocols of the children as required by staff of ECUKCIC.

5.3
ECUKCIC reserve the right to remove any Learner(s) from the course at the discretion of the instructor/leader without recourse to repayment for that course and against the client(s) will if necessary. Circumstances that may warrant exclusion from a course include (without limitation):

  • Intoxication

  • Use of recreational drugs

  • Abusive behaviour

  • Inappropriate/threatening or continued unsafe use of equipment

  • Inability to meet the rigours of the course for physical or mental reasons

For removal of any party under such conditions, ECUKCIC will not be liable for any losses as a result and ECUKCIC are also entitled to any reasonable costs arising from removal of said client(s) payable upon demand.

6.  ACCREDITED QUALIFICATIONS – LEARNER COmMITMENT

6.1
The Learner is required to attend all study days as stated in the written confirmation and/or in the course material from ECUKCIC

6.2
The Learner must submit their completed coursework to ECUKCIC by the given deadline date

6.3
In exceptional circumstances an extension may be granted to the Learner for submission of their coursework

6.4
Without the above permissions the late submission of portfolios will incur an administration fee of £1009.5   ECUKCIC will not accept submission of completed coursework any later than 20 months from the beginning of training, as coursework will need to be marked, verified and moderated within 2 years of commencing training.  Coursework will not be considered as current after this time and therefore qualifications need to be certificated within a 2 year timeframe at the most.  After this date retraining will need to be undertaken at the Learner`s own expense in order to achieve their qualification.

7. INSURANCE

7.1
ECUKCIC has Public Liability, Professional Indemnity and Employers Liability Insurance with Activities Industry Mutual, which covers Learners and staff during the taught elements of attending any ECUKCIC course or programme

7.2
ECUKCIC Learners are advised to provide their own personal accident insurance cover. Please note the conditions with your policy with regard "Hazardous Activities" and "working with hand tools".

7.3
For Forest School Leader training, the Learner is responsible for ensuring they have adequate and appropriate insurance cover to deliver their own outdoor play/learning experiences to their own client groups

8.  LIABILITY

8.1
ECUKCIC courses take place in the outdoors, which by its nature, is never free from hazard. While all reasonable precautions are taken to minimise the risk, the client accepts that accidents including serious injury and death can occur without ECUKCIC being at fault and to the extent that the client is taking part in an ECUKCIC course entirely at his or her own risk.

8.2
The client also recognises that ECUKCIC is not responsible for loss or damage to the personal property of the client, including vehicles, money, clothing and or equipment whilst attending any training or course.

8.3
The client also recognises that apart from the Level 3 Forest School Practitioner Training and successful completion thereof; attendance of an ECUKCIC course in no way qualifies him/her to teach the course content. It is not intended that any instructions provided to any Learner while on any course will in any way qualify those Learner(s) to instruct any third party and no warranty is made to that effect. ECUKCIC hereby excludes any liability it might have to any third party in respect of any loss or damage suffered or incurred by that third party in its reliance on any skills taught by any Learner on the basis of having attended any ECUKCIC course.

8.4
ECUKCIC accepts no responsibility for any injury during a course from any instruction or information not given by ECUKCIC appointed instructors or assistants.

8.5
ECUKCIC also takes no responsibility for any injury occurring as a result of the client`s failure to follow instructions.

8.6
ECUKCIC only accepts liability for physical injury to the Learner that is shown to result from negligence of ECUKCIC.

8.7

RE Covid-19 - the client confirms they will inform us if they are experiencing Covid-19 symptoms and will not attend any days with Earthcraftuk, until safe to do so. If attending accredited training, every effort will be made to support you to catch up on days missed.

9. COMPLAINTS

9.1
In the unlikely event that a client has cause for complaint about an ECUKCIC course, the complaint should be made to a representative of ECUKCIC during the event in order that corrective action can be taken if necessary.

9.2
The client acknowledges that it is unreasonable not to raise an issue during a course and ECUKCIC will not accept a complaint after the end of the course.

9.3
If the complaint is about a member of staff, then please contact the Directors of ECUKCIC Clair Hobson or Scott Woolsgrove setting out the nature and evidence relating to the complaint within 28 days or this complaint will not be upheld.

10. ALLERGIES

10.1
If you suffer from any allergies at all from substances such as nuts etc, then we advise you to fully cater for yourself. We cannot be held responsible should you have any allergic reaction, should you choose to consume any foodstuffs provided through ECUKCIC.

10.2
Learners with allergies will need to state accordingly on their booking form and be responsible for their own welfare during any ECUKCIC course

11. DBS

11.1
All ECUKCIC appointed staff are DBS enhanced checked.

12. Intellectual Property

12.1
All intellectual property rights shall be owned by ECUKCIC. You are entitled to use any reports, course materials or other documents only for the purpose they were provided for.

13. PHOTOGRAPHY AND VIDEO

13.1
We often take photographs throughout our courses and events to use for our promotional material and website. Your acceptance is acknowledged unless you notify us accordingly – thank you.

13.2
We would also ask that you do not take video recordings during our training – thank you.

13.3
We would also ask please that that you gain the permission of your peers before using any photographs of them in perhaps your coursework – thank you.

14. Veteran Trees

14.1
Veteran Trees is a project funded by the Armed Forces Covenant Fund Trust. The terms above referencing payments and cancellations do not apply.

14.2

RE Covid-19 - participants confirm they will inform us if they are experiencing symptoms and will not attend any days with Earthcraftuk, until safe to do so.

EarthCraftuk Partnership (ECUKP)

The work carried out by EarthCraftuk Partnership is usually (but not limited to) practical outdoor work in building and providers of wood shelters and structures in educational settings for Forest School and Outdoor Learning programmes.

1. PAYMENT

1.1
50% non refundable deposit is required to purchase materials and secure the labour time

1.2
The balance is required 28 days at the latest, prior to commencement of work

2. CANCELLATION

2.1
For practical outdoor work such as site installations – ECUKCIC reserve the right to postpone the work should the weather conditions be unsafe.

2.2
For practical outdoor work booked through ECUKP – cancellations of booked labour time within 56-28 days of the scheduled date for the work to begin, will result in 50% of the agreed labour costs being charged/retained.

2.3
For site installation work where 50% deposits have been paid to cover materials and secure the labour time. Deposits are non refundable however the materials purchased will be delivered and left with the client.

2.4
Full payment will be charged/retained if cancelled within 28 days of commencement of work to be carried out.  Materials purchased will be delivered to the client`s site.

3. INSURANCE

3.1
ECUKP has Public and Employers Liability Insurance with Activities Industry Mutual, to undertake building and providers of wood shelters and structures in educational settings for Forest School and Outdoor Learning programmes.

3.2
Once the materials are on site, they are the responsibility of the client to keep safe. ECUKP are not responsible for any loss or damage to materials when ECUKP staff are not on site.­­­­

Medical Consent Declaration

 

Declaration:  I understand that by agreeing to the Medical Consent Declaration (MCD), I am declaring: 

  1. That I am of sufficient physical fitness to participate

  2. That I recognise that the course(s) has an element of personal risk, and however unlikely, the risk can become a reality

  3. In the event of an accident, I agree to receiving immediate first aid by a qualified First Aider

  4. That EarthCraftuk CIC and EarthCraftuk CIC appointed staff or landowner, will not be liable now, or at any time in the future for any loss, expense, damage or claim I may have against them for any damage to myself or my property as a result of my participation in this course(s).  EarthCraftuk will only accept liability for physical injury to a client that is proven to result from negligence on the part of EarthCraftuk CIC.

  5. I consent to photographs being taken and understand that these may be used for EarthCraftuk`s promotional purposes (please cross through if you do not consent). Please do not take videos of the instructors and we ask that you request permission from your peers should you wish to take photos or videos of them.

  6. I understand that the training takes place outside in the woodland and will come dressed accordingly

  7. If undertaking Forest School Training, I confirm that unless exceptional circumstances, I will attend all course elements and commit to completing the coursework and Forest School programme delivery within the agreed deadline dates

  8. If undertaking Forest School Training, I understand that the Level 1 Forest School qualification is an introductory and learning programme only and does not qualify me to lead/run Forest School Programmes, nor advertise that I do.

  9. If undertaking Forest School Training, I understand that this Level 2 Forest School Assistant Training Programme does not qualify me to lead Forest School programmes – it qualifies me as an Assistant to work with a qualified Level 3 Forest School Leader.

  10. If undertaking Forest School Training, apart from during my training, I understand I will only commence my own Forest School programmes when I have successfully achieved my Level 3 Certificate for Forest School Leaders.

  11. If undertaking Forest School Training, I understand that assessments outside of Kent will incur an additional charge of £75 plus 40p per mile (calculated from the Kent border).

  12. If undertaking Forest School Training, I will have full Public Liability Insurance and relevant permissions in place BEFORE I run ANY Forest School programmes

  13. If undertaking Forest School Training, I confirm that I am DBS enhanced checked and suitable to work with children and vulnerable adults. Freelance Leaders will be required to obtain their own enhanced DBS disclosure.

  14. That I have read and understood the terms and conditions as displayed on the website www.earthcraftuk.com.
